General Terms and Conditions (GTC)
Thank you for your interest in Playground in Paradise. By using our services, purchasing, renting, or making use of our offerings, you agree to the following General Terms and Conditions (GTC).
1. Scope
These Terms and Conditions apply to all purchase, rental, service, and event services concluded through Playground in Paradise online, by phone, by email, or directly in the shop in St. Moritz.
2. Conclusion of contract
- The contract is concluded with our written or oral confirmation.
- For online orders, the contract is concluded with the confirmation of the order and payment.
- For bookings made by telephone, in writing or in person, the contract is deemed concluded upon our acceptance and receipt of payment.
- Automatic confirmation emails do not constitute binding acceptance of the contract.
3. Deposit and payment terms
- A deposit of CHF 200.- is required.
- If the total amount is less than CHF 200.-, the full amount must be paid as a deposit.
- Online bookings are payable immediately.
- For bookings made by telephone, in writing or in person, a payment link will be sent via email, which will be 3 days must be paid.
- If payment is not made on time, we reserve the right to cancel the booking and reassign the service.
4. Booking fees and processing fees
- For bookings not made online, a Processing fee of CHF 30.- raised.
- This fee is non-refundable, even in the case of cancellations.
5. Cancellation and withdrawal
- Cancellations must be made in writing (via email).
- Any advance payments already made are only refundable if the cancellation is due to force majeure (e.g. verifiable illness, accident or official restrictions).
- If the cancellation occurs less than 24 hours before the appointment, the entire amount will be charged.
- If the customer can provide a replacement participant, no cancellation fee will be charged.
6. Liability
- Playground in Paradise is not liable for slight negligence.
- We are liable for gross negligence or intent within the statutory framework.
- Customers are obliged to treat rental equipment carefully and report any damage immediately.
- Damage caused by improper use will be charged in full to the customer.
- Playground in Paradise assumes no liability for Theft or loss of personal belongings.
7. Protection of minors
- Young people between 16 and 18 years require written consent from a parent or guardian.
- This must be presented when picking up or using the service.
- The booking can be canceled without consent.
8. Data protection
- Personal data will only be used to process the contract and will not be passed on to third parties.
- Our full privacy policy is available on our website.
9. Changes to the Terms and Conditions
- Changes to the Terms and Conditions only apply to future contracts.
- Existing customers will be informed of any significant changes.
- Should any clause of these Terms and Conditions be invalid, the remainder of the Terms and Conditions shall remain valid.
10. Applicable law and place of jurisdiction
- Swiss law applies.
- Place of jurisdiction is St. Moritz, Switzerland.
